You represent and warrant that:

  • You own or have permission to provide the Submissions;

  • Your Submissions do not violate any law or third-party rights;

  • Your Submissions do not contain unlawful, defamatory, harassing, obscene, or harmful material; and

  • Your Submissions do not contain malicious software or unauthorized personal information of others.

We reserve the right, but not the obligation, to monitor, review, remove, or refuse any Submission at our sole discretion.

5. Donations and Financial Transactions

If you make a donation or other financial contribution through the Site, you agree that:

  • Payments may be processed through third-party service providers such as Squarespace, Stripe, PayPal, or similar vendors;

  • DVMC does not store complete payment card information;

  • Donations are generally non-refundable except as required by applicable law; and

  • You are authorized to use the selected payment method.

Third-party payment processors may have separate terms and privacy policies that govern your transaction.

6. Third-Party Links and Services

The Site may contain links to third-party websites, applications, or services that are not owned or controlled by DVMC. We are not responsible for the content, security, availability, accuracy, privacy practices, or policies of third-party services.

DVMC DOES NOT WARRANT THAT:

  • DEFECTS WILL BE CORRECTED; OR

  • THE SITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Oregon, and you consent to the jurisdiction and venue of those courts.

13. Force Majeure

DVMC shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, internet outages, labor disputes, acts of terrorism, governmental actions, power failures, or other force major events.

14. Severability and Waiver

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

No waiver of any provision of these Terms shall constitute a continuing waiver unless expressly made in writing.

15. Termination

We reserve the right to terminate or suspend your access to the Site, without notice, for conduct that we believe violates these Terms or is otherwise harmful to DVMC, users, or third parties.

Upon termination, provisions of these Terms that by their nature should survive termination shall survive, including intellectual property protections, disclaimers, indemnification obligations, and limitations of liability.
